By accessing or using ChessHelper.ai ("the Service"), including our website at chesshelper.ai and our Chrome extension, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after any changes constitutes acceptance of the updated Terms.

ChessHelper.ai provides AI-powered chess analysis through a web application and Chrome browser extension. The Service uses an advanced chess engine to analyze chess positions and suggest moves. Features include:

• Real-time chess position analysis
• Move suggestions and evaluation
• Integration with chess platforms via browser extension
• Free and paid subscription tiers

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

ChessHelper.ai offers both free and paid subscription plans. For paid plans:

• Payments are processed securely through Stripe. We do not store your payment card details.
• Subscriptions automatically renew at the end of each billing period unless cancelled.
• You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period.
• You may cancel your subscription at any time. No refunds are provided for partial billing periods.
• We reserve the right to change pricing with reasonable notice. Price changes will not affect your current billing period.

You agree not to:

• Reverse engineer, decompile, or disassemble any part of the Service
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service for any illegal purpose
• Share your account credentials with others
• Resell or redistribute the Service without our written consent
• Use automated systems to abuse API rate limits or overload our servers
• Circumvent any usage limits imposed on your account

All content, features, and functionality of the Service (including but not limited to software, text, graphics, logos, and design) are owned by ChessHelper.ai and are protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

Certain components of the Service incorporate open-source software distributed under the GNU General Public License. Our use of such software complies with the applicable license terms.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHESSHELPER AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Service interruption or downtime
• Account bans or restrictions on third-party platforms
• Inaccurate analysis or move suggestions
• Any damages resulting from your use of or inability to use the Service

Our total liability for any claims arising from the Service shall not exceed the amount you have paid us in the twelve (12) months prior to the claim.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT WARRANT THE ACCURACY OR RELIABILITY OF ANY ANALYSIS OR MOVE SUGGESTIONS PROVIDED BY THE SERVICE.

You agree to indemnify, defend, and hold harmless ChessHelper.ai and its owners, officers, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights or terms of service
• Any consequences resulting from your use of the Service on third-party platforms

We may terminate or suspend your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive (including liability limitations, indemnification, and disclaimers).

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed. The remaining provisions shall continue in full force and effect.
